เพราะถ้าหากไม่กระทำผิด กฎหมายใดๆ ก็มิอาจทำอะไร แก่ใครๆ ได้เลย

เฟซบุ๊กส่วนตัวของนางอมรัตน์ “มีที่ไหน ขนาดคิดว่าเป็นแค่ข่าวลือก็ยังดีใจ good night” ซึ่งข้อความดังกล่าวสอดรับกับกรณีที่นายสมศักดิ์ได้โพสต์ในเฟซบุ๊กดังกล่าว
จากการกระทำดังกล่าวเป็นการกล่าวหาให้ร้าย ซึ่งก่อให้เกิดความเสียหาย เสื่อมเสียพระเกียรติยศแก่องค์พระมหากษัตริย์
ซึ่งก่อให้เกิดความสับสน ความตื่นตระหนกต่อประชาชนชาวไทย และการเขียนข้อความของนางอมรัตน์ เกิดขึ้นในเวลาใกล้เคียงกับที่นายสมศักดิ์และบุคคลอื่นๆ อีกหลายคนที่ใช้สร้างและปล่อยข่าวลือ
สร้างความเสื่อมเสียต่อองค์พระมหากษัตริย์และสถาบันพระมหากษัตริย์
ซึ่งข้อความที่โพสต์แม้จะไม่ได้ระบุชื่อตามข่าวลือ แต่เมื่อดูภาพรวมและแปลเจตนาได้ว่า นางอมรัตน์ โพสต์ข้อความโดยมุ่งหมายถึงองค์พระมหากษัตริย์ โดยใช้ข้อความอันเป็นการดูหมิ่น เปรียบเปรย เสียดสี ให้ร้าย ทำให้เสื่อมเสียเกียรติยศ
จากการกระทำของนายสมศักดิ์และนางอมรัตน์ จึงเป็นความผิดตามประมวลกฎหมายอาญา มาตรา ๑๑๒ และ พ.ร.บ.ว่าด้วยการกระทําความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. ๒๕๕๐ มาตรา ๑๔(๒) เพื่อให้ได้รับโทษตามกฎหมายโดยได้มอบเอกสารที่เกี่ยวข้องให้ด้วย

On personal Facebook of Mr. Amornrat “Where else can this happen? Just thinking that it is just a rumor, we feel glad. Good night.” This message agrees to Mr. Somsak’s message on the Facebook.
This action is defamatory and damaging to the King’s dignity.
This has caused confusion and panic among Thai people. Mrs. Amornrat’s message writing occurred almost the same time as those of Mr. Somsak and other people spread the rumor.
This has caused defamation towards the King and the monarchy.
Although the posted message did not specify names, it can be implied from Mrs. Amornrat’s message that her message meant the King. Her message belittled, hinted, satirized, slandered, and damaged the King’s dignity.
Mr. Somsak and Mrs. Amornrat’s actions are wrongdoing according to Criminal Code, Section 112, and Computer – Related Crime Act B.E. 2550, Section 14(2). So, all relevant documents have been submitted to official for further legal persecution and punishment.
