การกระทำอันไม่สมควรต่อธงชาติและบทกำหนดโทษ

ตามระเบียบสำนักนายกรัฐมนตรี ว่าด้วยการใช้ การชัก หรือการแสดงธงชาติและธงของต่างประเทศในราชอาณาจักร พ.ศ. 2529 การกระทำต่อธงชาติโดยไม่ให้ความเคารพ มีดังนี้

การกระทำอันเป็นการเหยียดหยามต่อธงชาติ ได้แก่ การกระทำต่อธงชาติรูปจำลองของธงชาติ หรือแถบสีธงชาติ ด้วยเจตนาเหยียดหยามประเทศชาติ เช่น ฉีกทำลาย ถ่มน้ำลายรด ใช้เท้าเหยียบ วางเป็นผ้าเช็ดเท้า ซึ่งเป็นการแสดงความดูถูกดูหมิ่นเหยียดหยามชาติไทย

การกระทำที่ไม่สมควรต่อธงชาติ รูปจำลองของธงชาติ หรือแถบสีธงชาติ เช่น

การประดิษฐ์รูป ตัวอักษร ตัวเลข หรือเครื่องหมายอื่นในผืนธงรูปจำลองของธง หรือแถบสีของธง

การใช้ ชัก หรือแสดงธง รูปจำลองของธง หรือแถบสีของธงอันมีลักษณะตามข้อ (1)

การใช้ ชัก หรือแสดงธง รูปจำลองของธง หรือแถบสีของธงไว้ ณ สถานที่หรือวิธีอันไม่สมควร

การประดิษฐ์ธง รูปจำลองของธง หรือแถบสีธงไว้ ณ ที่หรือสิ่งใด ๆ โดยไม่สมควร

แสดงหรือใช้สิ่งใด ๆ ที่มีรูปธง รูปจำลองของธง หรือแถบสีธงอันมีลักษณะตามข้อ (4)

การกระทำการต่อธงชาติโดยไม่ให้ความเคารพมีความผิด ต้องระวางโทษตามกฎหมายดังนี้

***กระทำการใด ๆ ต่อธงชาติหรือเครื่องหมายอื่นใด อันมีความหมายถึงรัฐ เพื่อเหยียดหยามประเทศชาติ ต้องระวางโทษจำคุกไม่เกิน 2 ปี หรือปรับไม่เกิน 4,000 บาท หรือทั้งจำทั้งปรับ (ประมวลกฎหมายอาญา มาตรา 118)

***กระทำการใด ๆ ต่อธงชาติ รูปจำลองของธงชาติ หรือแถบสีของธงชาติ ตามระเบียบสำนักนายกรัฐมนตรีข้อ 19.2 ข้างต้น (ข้อความดังกล่าวลอกมาจากพระราชบัญญัติธงอีกทีหนึ่ง) ต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 2,000 บาท หรือทั้งจำทั้งปรับ (พระราชบัญญัติธง พ.ศ. 2522 มาตรา 53)

***ผู้ใดกระทำการกระทำใด ๆ อันมีลักษณะเป็นการเหยียดหยามต่อธง รูปจำลองของธงชาติ หรือแถบสีของธงชาติ ต้องระวางโทษจำคุกไม่เกิน 6 เดือน หรือปรับไม่เกิน 1,000 บาท หรือทั้งจำทั้งปรับ (พระราชบัญญัติธง พ.ศ. 2522 มาตรา 54)

Let’s take a look at the penalties for those who violate Thailand’s national flag. What are consequences of such karma (action)?

Inappropriate manners towards national flag and penalty

In accordance with the Rules of the Office of the Prime Minister B.E. 2529 on the using, hoisting, or presenting the national flag and foreign flags in the Kingdom of Thailand, the following actions are regarded as​ disrespectful.

Any person who uses or presents a flag, a replica of a flag or color bands of a flag with an intention to insult the country such as tearing, spitting on, stepping on, laying it as a doormat, which insult the Kingdom of Thailand.

Inappropriate manners towards a flag, a replica of a flag or color bands of a flag are for instance

Putting pictures, letters, numbers, or other symbols into a flag, a replica of a flag or color bands of a flag

Using, hoisting, or presenting a flag, a replica of a flag or color bands of a flag as described on (1)

Using, hoisting, or presenting a flag, a replica of a flag or color bands of a flag at an inappropriate place or in an inappropriate manner

Creating a flag, a replica of a flag or color bands of a flag at an inappropriate place or in an inappropriate manner

Using, hoisting, or presenting a flag, a replica of a flag or color bands of a flag as described on (4)

Inappropriate manners towards national flag have following penalty according to laws.

***Any misconduct towards the national flag or other objects symbolizing state to defame the country shall be liable to imprisonment for a term not exceeding two years, or to a fine not exceeding four thousand baht or to both (Criminal Code, Section 118)

***Any inappropriate manners towards a flag, a replica of a flag or color bands of a flag as prescribed by mentioned the Rule of the Office of the Prime Minister No. 19.2 as mentioned above, shall be liable to imprisonment for a term not exceeding one year, or to a fine not exceeding two thousand baht or to both (Flag Act B.E. 2522, Section 53)

***Any insulting manners towards a flag, a replica of a flag or color bands of a flag shall be liable to imprisonment for a term not exceeding six months, or to a fine not exceeding one thousand baht or to both (Flag Act B.E. 2522, Section 54)
