วันนี้ (๒๐ เม.ย. ๖๔) มีการประชุมมหาเถรสมาคม(มส.) นายสิปป์บวร แก้วงาม ผู้ตรวจราชการสำนักงานพระพุทธศาสนาแห่งชาติ(พศ.) แถลงข่าวว่า
พศ.ได้นำกรณีคณะสงฆ์วัดสระเกศฯ ประกอบพิธีครองผ้าไตรจีวรรับเข้าหมู่สงฆ์ อดีตพระพรหมสิทธิ อดีตพระราชกิจจาภรณ์ อดีตพระราชอุปเสณาภรณ์ อดีตพระศรีคุณาภรณ์ และอดีตพระครูสิริวิหารการ
ซึ่งทั้ง ๕ รูปอยู่ในช่วงที่ศาลพิพากษาให้รอลงอาญา ๒ ปี
ประกอบกับในช่วงการดำเนินคดีเงินทอนวัดเมื่อปี ๒๕๖๑ อดีตพระเถระทั้ง ๕ รูป ได้ถูกดำเนินการให้พ้นจากสมณเพศ ตามมาตรา ๓๐ พ.ร.บ.คณะสงฆ์ ที่ระบุว่า เมื่อจะต้องจำคุก กักขังหรือขังพระภิกษุรูปใดตามคำพิพากษาหรือคำสั่งของศาล เจ้าหน้าที่ผู้มีอำนาจหน้าที่ปฏิบัติการให้เป็นไปตามคำพิพากษาหรือคำสั่งของศาล มีอำนาจดำเนินการให้พระภิกษุรูปนั้นสละสมณเพศเสียได้ และให้รายงานให้ศาลทราบถึงการสละสมณเพศแล้ว
การที่อดีตพระเถระทั้ง ๕ รูป ทำพิธีกลับมาห่มจีวรอีกครั้ง อาจเข้าข่ายความผิดตามมาตรา ๒๐๘ ประมวลกฎหมายอาญา ที่ระบุว่า ผู้ใดแต่งกายหรือใช้เครื่องหมายที่แสดงว่าเป็นภิกษุ สามเณร นักพรตหรือนักบวชในศาสนาใดโดยมิชอบ เพื่อให้บุคคลอื่นเชื่อว่าตนเป็นบุคคลเช่นว่านั้น ต้องระวางโทษจำคุกไม่เกิน ๑ ปี หรือปรับไม่เกิน ๒๐,๐๐๐ บาท หรือทั้งจำทั้งปรับ
อีกทั้งยังปรากฏภาพพระเทพรัตนมุนี ผู้รักษาการแทนเจ้าอาวาสวัดสระเกศฯ นั่งเป็นประธานสงฆ์ในพิธีดังกล่าวด้วย
ซึ่งเหมือนเป็นการส่งเสริมสนับสนุน จึงอาจเข้าข่ายความผิดละเมิดจริยาพระสังฆาธิการด้วย
มส.พิจารณาตามข้อหารือของพศ.อย่างถี่ถ้วนและเห็นว่า คณะสงฆ์ต้องปฏิบัติตามกฎหมายคณะสงฆ์ ดังนั้นอดีตพระเถระทั้ง ๕ รูปจึงถือว่าพ้นจากความเป็นสงฆ์แล้ว และมอบให้ทางพศ.ไปหารือพิจาราณาแนวทางในการดำเนินการต่อไป
ขออนุโมทนาต่อทั้งมหาเถรสมาคม และสำนักงานพุทธศาสนาแห่งชาติ ที่ช่วยกรุณาปกป้องพระธรรมวินัย มิให้พวกอลัชชีเข้ามาอาศัยหากินและบ่อนทำลาย

Today (April 20, 2021), during the meeting of the Sangha Supreme Council, Inspector of the National Office of Buddhism Sipbovorn Kaewngam made a statement that…
The National Office of Buddhism brought up the case of the clergy of Saket Ratcha Wora Maha Wihan Temple held a monk robe wearing ceremony and accepting former Phra Phrom Sitthi, Phra Raj Kijjaporn, former Phra Raj Uppasenaporn, former Phra Sri Kunaporn, and former Phra Kru Siriviharakarn, into the clergy.
All five of them are during two-year parole granted by the court.
During the legal persecution of temple funds embezzlement case in 2018, the five former senior monks departed monkhood according to Section 30 of the Sangha Act which states that before imprisoning any monk according to court judgement, officials, under provision of court ruling, must have that monk depart his monkhood, and report that to the court.
That the five former senior monks have worn monk robe again may violate Section 208 of the Criminal Code which states that whoever, wrongfully dressing or using the symbol manifesting oneself to be Buddhist monk or novice, holy man or clergyman of any religion so as to make the other people believe that oneself to be such person, shall be imprisoned not over one year or fined not over two thousand Baht, or both.
There was also picture of Phra Thep Rattanamunee, acting abbot of the Saket Temple sitting as a chairperson of that ceremony.
This can be viewed as support which violates the ethics of ecclesiastical official monk. The Sangha Supreme Council has thoroughly reviewed details submitted by the National Office of Buddhism and come up with a resolution that the clergy must comply with law governing the monastic community. As a result, the former five senior monks are deemed to have departed monkhood. Consequently, the National Office of Buddhism will have to come up with measures to further handle the issue.
I rejoice in the Sangha Supreme Council and the National Office of Buddhism’s protecting the code of monastic rules, and not letting shameless monks take advantage from and undermine the monastic discipline.
