๑. ถาม มาตรา ๑๑๒ มีมาตั้งแต่ พ.ศ. ใด?
ตอบ มีมาตั้งแต่ ร.ศ.๑๒๗ (พ.ศ.๒๔๕๓) เป็นมาตรา ๙๘ , และในปี พ.ศ.๒๔๙๙ มีการตราประมวลกฎหมายอาญา พ.ศ.๒๔๙๙ ขึ้นใช้แทนกฎหมายลักษณะอาญาฉบับเดิม โดยย้ายบทบัญญัติมาตรา ๙๘ ของกฎหมายลักษณะอาญาไปอยู่ในมาตรา ๑๑๒ ของประมวลกฎหมายใหม่ โดยยกเลิกบทยกเว้นความผิดพร้อมแก้ไขเนื้อความเป็นว่า “ผู้ใดหมิ่นประมาท ดูหมิ่น หรือแสดงความอาฆาตมาดร้าย พระมหากษัตริย์ พระราชินี รัชทายาท หรือผู้สำเร็จราชการแทนพระองค์ ต้องระวางโทษจำคุกไม่เกินเจ็ดปี” โดยมาตรา ๑๑๒ ถูกบัญญัติไว้ในหมวดความผิดเกี่ยวกับความมั่นคงแห่งราชอาณาจักร

ตอบ หากมาตรา ๑๑๒ ทำให้ประชาชนเดือดร้อน ตลอดเวลาที่ผ่านมา มีการเขียนปรับแก้รัฐธรรมนูญมาหลายฉบับ มาตรา ๑๑๒ คงถูกแก้ไปนานแล้ว แต่ที่ยังคงอยู่ ก็เพราะประชาชนมิได้เดือดร้อน
๖. ถาม ประชาชนจะได้ประโยชน์อะไรกับการล้มเลิกมาตรา ๑๑๒?
ตอบ เมื่อประชาชนไม่รู้สึกลำบากเดือดร้อนต่อการคงอยู่ของมาตรา ๑๑๒ การยกเลิกมาตรา ๑๑๒ ประชาชนคงไม่ได้อะไร แต่ที่น่าจะได้คือ พวกที่จ้องล้มเจ้า และผู้ที่ต้องคดีหมิ่น จาบจ้วงสถาบัน
๗. ถาม เห็น นายปิยบุตร บอกว่า คนที่เสนอให้แก้ไขมาตรา ๑๑๒ มีเยอะ?
ตอบ คุณลองไปบอก นายปิยบุตร ว่า ไอ้ที่บอกว่าคนเสนอแก้ ๑๑๒ มีเยอะน่ะ เรามาลองทำประชามติกันดูไหม หากคนส่วนใหญ่ในประเทศเขาไม่แก้ นายปิยบุตร และพวกจะรับผิดชอบอย่างไร
ชอบทำตัวเป็นดังปลวกที่คอยแต่จะกัดแทะเสาบ้านอยู่ตลอด
๘. ถาม ทำไมประเทศนี้ต้องมีมาตรา ๑๑๒?
ตอบ มาตรา ๑๑๒ นอกจากจะคุ้มครอง ปกป้องรักษาความปลอดภัย และพระเกียรติของ สถาบันพระมหากษัตริย์ อันทรงเป็นพระประมุขของประเทศแล้ว
ยังเป็นการรักษาศักดิ์ศรีของประเทศ มิให้ใครหรือผู้ใดมาดูหมิ่น เหยียดหยาม ได้ตามอำเภอใจ ทั้งยังเป็นการรักษาความมั่นคงของประเทศด้วย เพราะสถาบันพระมหากษัตริย์เป็น ๑ ใน ๓ เสาหลักของประเทศ

1. Question : When did Thailand’s lese-majeste law (Section 112) start?
Answer : It started in 1910 and was called Section 98. In 1956, there was an enactment of the criminal code to replace the former criminal law by changing from the section 98 of the criminal law to Section 112 of the new criminal code. The new law amended the content to be “”Whoever defames, insults or threatens the King, the Queen, the Heir-apparent or the Regent, shall be punished with imprisonment of maximum seven years.” The Section 112 is under the Offenses against the Internal Security of the Kingdom.
2. Question : Section 112 started in which era? Who were the government?
Answer : Section 98 started during the reign of His Majesty King Chulalongkorn (King Rama V). It was changed to Section 112 during the reign of His Majesty King Bhumibol Adulyadej the Great (King Rama IX) when Field Marshal Plaek Phibunsongkhram was prime minister.
3. Question : In 1956, when Thailand had Section 112, how many population Thailand had?
Answer : In 1956, Thailand had 22,811,701 population.

5. Question : How has the Section 112 impacted people’s lives?
Answer : If the Section 112 has caused troubles for people, the Section 112 must have long been amended because there have previously been several constitutional amendments. It still exists because people have not been affected.
6. Question : What are the benefits that people will obtain after revocation of the Section 112?
Answer : Because people are not impacted by existence of the Section 112, people will not gain anything from the Section 112 revocation. Those who benefit are anti-monarchy group and those with royal defamation charges.
7. Question : Why Mr. Piyabutr said there are a lot of people calling for Section 112 amendment?
Answer : Why don’t you propose to Mr. Piyabutr to do a referendum? What if it turns out that the majority people don’t want to amend? How would Mr. Piyabutr and his group be responsible? He behaves like termite that continuously destroys house pillars.
8. Question : Why this country needs to have the Section 112?
Answer : The Section 112 not only protects the safety and honor of the royal institution as well as prevents someone from defaming and insulting the national dignity, but also maintains the national stability. That is because monarchy is one of the three major national institutions.
People with little education like me can think of this.
I don’t understand why highly educated people cannot think of.
