เรามาย้ำเตือนความเข้าใจ และความทรงจำกันหน่อยดีกว่า

เมื่อองค์พระบาทสมเด็จพระปรเมนทรรามาธิบดีศรีสินทรมหาวชิราลงกรณ พระวชิรเกล้าเจ้าอยู่หัว ได้ทรงมีพระมหากรุณาธิคุณ และทรงใช้พระราชอำนาจตามกฎหมายลดโทษให้แก่นายทักษิณจาก ๘ ปี ให้เหลือ ๑ ปี ที่จะต้องติดคุก
ผู้มีหน้าที่จักต้องปฏิบัติตามให้เป็นไปตามพระราชวินิจฉัย ก็คือ นายกรัฐมนตรี รัฐมนตรีกระทรวงยุติธรรม อธิบดีกรมราชทัณฑ์ และเจ้าหน้าที่ราชทัณฑ์
แต่ข้อเท็จจริงที่ปรากฏ คือ นายกรัฐมนตรีของพรรคเพื่อไทยทั้ง ๒ คน และรัฐมนตรีกระทรวงยุติธรรม อธิบดีกรมราชทัณฑ์ และเจ้าหน้าที่ราชทัณฑ์ ได้ทำการละเมิดพระราชอำนาจ ด้วยการทุจริต เพิกเฉย ปล่อยปละละเลย ให้เจ้าหน้าที่ระดับปฏิบัติทุจริต ฉ้อฉล ทำอุบาย ให้นายทักษิณ มิต้องติดคุกแม้แต่วันเดียว ด้วยการแสดงแกล้งเป็นผู้ป่วยวิกฤต จนต้องส่งโรงพยาบาลตำรวจ และได้ไปนอนในห้องวีไอพี ชั้น ๑๔
ซึ่งเจ้าหน้าที่ผู้ปฏิบัติงานกระทำการ “ละเมิดพระราชอำนาจ” ก็มีตั้งแต่พยาบาลเวรประจำกรมราชทัณฑ์ หมอเวรประจำกรมราชทัณฑ์ รวมทั้งเจ้าหน้าที่เวรของกรมราชทัณฑ์ หมอเวรโรงพยาบาลตำรวจที่ให้การวินิจฉัย ผู้อำนวยการโรงพยาบาลตำรวจ เจ้าหน้าที่ผู้เกี่ยวข้อง และตัวนายกรัฐมนตรีทั้งสองของพรรคเพื่อไทย
ไม่เว้นแม้แต่นักการเมืองของพรรคเพื่อไทยบางคน ที่ออกมาให้สัมภาษณ์ว่า นายทักษิณเป็นผู้ป่วยในขั้นวิกฤต ซึ่งเป็นความเท็จ
บุคคลเหล่านี้ถือได้ว่า ร่วมกันละเมิดพระราชอำนาจโดยมีเจตนาให้นายทักษิณมิต้องได้รับโทษตามพระราชวินิจฉัย
และเข้าข่ายละเว้นการปฏิบัติหน้าที่ตามประมวลกฎหมายอาญามาตรา ๑๕๗
ส่วนจักผิดกฎหมายอาญามาตรา ๑๑๒ หรือไม่
นั้นก็ต้องวินิจฉัยเป็นรายบุคคล และเป็นกรณีไป
ส่วนนักการเมืองและข้าราชการ ก็อาจจะมีความผิดกรณีทุจริต ประพฤติมิชอบต่อหน้าที่ ซึ่งก็มีประมวลกฎหมายอาญามาตรา ๑๕๗
บุคคลทั้งหมดดังกล่าวมา ประชาชนทั่วไปสามารถไปแจ้งความร้องทุกข์กล่าวโทษแก่เจ้าพนักงานสอบสวนได้ทุกแห่งในแผ่นดินนี้

His Majesty King Maha Vajiralongkorn Bodindradebayavarangkun graciously exercised his legal authority to reduce Mr. Thaksin Shinawatra’s sentence from eight years to one year in prison.
The Prime Minister, the Minister of Justice, the Director-General of the Department of Corrections, and other corrections officials are responsible for implementing the King’s royal pardon.
According to public reports and allegations, two Prime Ministers from the Pheu Thai Party, the Minister of Justice, the Director-General of the Department of Corrections, and corrections officials may have violated His Majesty’s royal authority through corruption, neglect, or negligence. It is claimed they enabled operational officials to engage in corruption and fraud, allegedly plotting so that Mr. Thaksin would not spend a single day in prison by portraying him as critically ill, resulting in his transfer to the Police General Hospital and accommodation in a VIP room on the 14th floor.
The officials alleged to be involved in this violation of royal authority reportedly include nurses on duty at the Department of Corrections and doctors assigned to the Department of Corrections, as well as the Department of Corrections’ duty officer, the doctor on duty at the Police General Hospital who issued the diagnosis, the Director of the Police General Hospital, relevant officials, and the two Prime Ministers from the Pheu Thai Party.
Some Pheu Thai Party politicians are also reported to have made statements claiming Mr. Thaksin was in critical condition.
These individuals are alleged to have jointly violated royal authority with the intent of avoiding punishment under the Royal Decree. They are also alleged to have violated Article 157 of the Criminal Code (dereliction of duty). Whether Article 112 of the Criminal Code applies must be determined on a case-by-case basis.
Politicians and civil servants may also be guilty of corruption and misconduct under Article 157 of the Criminal Code.
Any Thai citizen who believes wrongdoing has occurred may file a complaint with the police for investigation.
